Terms of Service.

These Terms of Service (“Terms”) govern your access to and use of marketingdoctrine.io and the Marketing Doctrine application (the “Service”), operated by The Second Click (“Marketing Doctrine,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

Marketing Doctrine helps you codify a marketing doctrine, generate on-doctrine content across your brands, and publish that content to destinations you connect. We may add, change, or remove features over time.

Accounts

You must provide accurate information when you create an account and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. You must be at least 16 years old and able to form a binding contract to use the Service.

Trials, subscriptions, and billing

The Service may be offered with a free trial. After any trial, paid plans renew automatically for the applicable period until cancelled. Payments are processed by Stripe. Fees are charged in advance and are non-refundable except where required by law. You can cancel at any time; cancellation takes effect at the end of your current billing period. We may change pricing on prospective notice.

Your content

You retain all rights to the doctrines, inputs, and content you create or upload (“Your Content”). You grant us a limited license to host, process, and transmit Your Content solely to operate the Service and to provide it to you — including sending it to our AI providers to generate output and to the destinations you connect when you instruct us to publish.

AI-generated output

The Service uses AI to generate content. AI output can be inaccurate or unsuitable, and similar output may be generated for others. You are responsible for reviewing, editing, and approving any output before you publish or rely on it. You are responsible for ensuring your content complies with applicable laws and the policies of any platform you publish to.

Third-party connections

When you connect a third-party platform such as WordPress, HubSpot, or LinkedIn, you authorize us to take the publishing actions you initiate on your behalf. Your use of those platforms is governed by their own terms, and you are responsible for your accounts with them. We are not responsible for third-party services.

Acceptable use

You agree not to misuse the Service. You will not use it to violate any law, infringe others’ rights, generate or distribute unlawful, deceptive, or harmful content, attempt to disrupt or reverse engineer the Service, or access it through unauthorized means.

Our intellectual property

The Service, including its software, design, and brand, is owned by The Second Click and protected by intellectual property laws. These Terms grant you no rights in our intellectual property except the limited right to use the Service as permitted here.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless The Second Click from claims, losses, and expenses arising out of Your Content, your use of the Service, or your violation of these Terms.

Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service. On termination, your right to use the Service ends; sections that by their nature should survive will survive.

Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance.

Governing law

These Terms are governed by the laws of the United States and the state in which The Second Click is established, without regard to conflict-of-laws principles.
